Washington, D.C., partner James Jorden moderated a panel discussion on “Developments and Forecast on Life Insurance Company Litigation UL, IUL, Annuities and LTC” at the 2019 convention of ACLI—the American Council of Life Insurers—in Boston on October 15, 2019. Besides Jim, the other speakers were Benjamin Edwards, VP and senior counsel of litigation at Lincoln Financial Group; Michael Gugig, VP of state government relations at Transamerica Life Insurance; and Christian Walker, VP of litigation at Athene.
Jim and the panel analyzed trends in life insurer litigation and predictions emphasizing developments in individual and class actions involving product features, sales and disclosure issues, guaranteed/nonguaranteed, COI case status, potential privacy and cyber-litigation, long-term-care exposures and emerging exposures from insurtech. The discussion also covered:
- Indexed universal life (IUL) claims in individual and class actions
- Annuity litigation concerning pricing and value, class certification, suitability and vicarious liability
- Long-term-care (LTC) insurance litigation and issues of provider eligibility, fraud, lapse and reinstatement, and rate increases.
