Behavioral Health Patients in the Emergency Room: Navigating EMTALA Risks


Florham Park partner George Kendall and of counsel Audrey Hale presented “Behavioral Health Patients in the Emergency Room: Navigating EMTALA Risks” to the New Jersey Hospital Association’s Behavioral Health Constituency Group (BHCG) on October 25. The BHCG is comprised of New Jersey hospital and health system executives responsible for behavioral health services. The group meets quarterly to discuss the latest issues affecting behavioral health patients and providers.

George and Audrey’s presentation provided a legal perspective on the proper treatment of behavioral health patients in the emergency department. The presentation outlined Emergency Medical Treatment and Labor Act (EMTALA) requirements and penalties for noncompliance. George and Audrey also reviewed recent cases and offered guidance on managing EMTALA risks in the emergency department.
