Fair Use: Factoring Copyright Limitations and Protections

Overview

Washington, D.C., associate Jennifer Criss moderated a panel for an American Bar Association-sponsored webinar on Tuesday, February 3. 

The webinar, titled, “Fair Use: Factoring Copyright Limitations and Protections,” focused on the ongoing debate of whether recent court decisions regarding the statutory defense to copyright infringement under 17 U.S.C § 107 have unduly limited, if not overridden, some of the exclusive rights in copyrighted works as set forth under 17 U.S.C. § 106.  The webinar also considered how “transformative use” considerations have skewed the balancing of statutory factors in determining whether a certain use is deemed a “fair use.”
