Irene Rizzi was quoted in a SHRM article titled “Think Before Asking About a Veteran’s Discharge Status.”
The article discussed the U.S. military’s various administrative discharge categories and how hiring managers should handle veteran job candidates. Employers can be at risk for discrimination lawsuits if they have policies against hiring candidates with less-than-honorable discharges.
Irene said that if an employer becomes aware of a job candidate’s discharge status, the employer should consider the individual nature of it, the time elapsed since the discharge and how it may relate to the position the candidate is applying for. There are also many laws that provide employment protections for military service members and hiring managers should keep in mind that exclusionary policies against veterans that did not receive an honorable discharge could have a disparate impact on protected characteristics, she said.
