Sheldon Eisenberg Quoted in Legal Newsline on Retail Lawsuit

Los Angeles partner Sheldon Eisenberg was quoted in a Legal Newsline article titled “The Gap Defeats Claims Over Inferior Clothing at Outlet Stores; Lawsuit Had No Merit, Attorney Says.”

Sheldon discussed a recent California Court of Appeal ruling in which the court found against a plaintiff who had brought deception claims against The Gap and Banana Republic outlet stores, arguing that she had been tricked into buying inferior clothing.

“I think the fundamental problem with the plaintiff’s claim was that she could not point to any false statements in connection with the sale of the Gap and Banana Republic items that she purchased,” he said. Sheldon also discussed what damages might be available in such a case should a court find that the use of a brand name had misled its customers.
